Terms of Service

Welcome to ITG Onsite Technicians (“we,” “our,” “us”). By accessing or using our IT Field Services, you (“Customer,” “you,” “your”) agree to comply with and be bound by these Terms of Service (“Terms”). Please read these Terms carefully before using our services. If you do not agree to these Terms, you may not access or use our services.

 

1. Services Provided

ITG Onsite Technicians offers IT field services, which include but are not limited to:

  • On-site technical support
  • IT hardware and software installation
  • Network setup and maintenance
  • Equipment repairs
  • IT troubleshooting and diagnostics
  • Systems upgrades and configuration

These services are provided to businesses, organizations, and individuals under a service agreement or as individual engagements.

 

2. Agreement and Scope of Services

Upon agreeing to these Terms, a service contract may be signed between you and ITG Onsite Technicians, specifying the scope of work, timelines, and fees associated with our services. The details of each engagement will be outlined in the specific service order or proposal.

The scope of services may vary depending on the specific needs of the customer, but any changes or additions to the services must be agreed upon in writing.

 

3. Customer Responsibilities

To ensure the successful delivery of services, you agree to:

  • Provide accurate information about your IT systems, network, and equipment.
  • Ensure that your premises are accessible to our technicians for the scheduled service appointments.
  • Ensure that there are no safety hazards at the service location.
  • Back up important data before services are performed, as ITG Onsite Technicians is not responsible for any data loss.

You acknowledge that any delays or issues caused by failure to meet these responsibilities may result in rescheduling, additional costs, or delays in the completion of services.

 

4. Pricing and Payment

The pricing for services will be outlined in a service proposal or agreement and may be based on an hourly rate, fixed fees, or a combination of both. Payment terms will be established prior to the commencement of services. Accepted payment methods include credit cards, bank transfers, or checks, unless otherwise agreed upon.

  • Hourly Services: You will be billed for the actual time spent on-site or providing remote support.
  • Flat-Rate Services: Services that are billed on a flat-rate basis will be agreed upon in advance, with payment due upon completion of services.

Late payments may incur additional charges, including interest and collection fees.

 

5. Confidentiality

We respect your privacy and will maintain confidentiality regarding your business information, proprietary data, and systems. We will not disclose or use any of your confidential information except as necessary to perform the services requested.
You also agree to maintain confidentiality about any proprietary information or materials provided by ITG Onsite Technicians.

 

6. Service Availability

ITG Onsite Technicians will make reasonable efforts to provide services on the agreed schedule. However, we do not guarantee availability, and we reserve the right to modify the service schedule due to unforeseen circumstances, such as:

  • Technical difficulties
  • Unavailability of necessary equipment
  • Force majeure (e.g., weather, natural disasters, strikes)

We will notify you as soon as possible if any delays or changes occur.

 

7. Limitation of Liability

To the fullest extent permitted by law, ITG Onsite Technicians is not liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the services we provide, including loss of profits, data, or business interruption.
Our liability will be limited to the total amount paid by you for the specific service(s) that gave rise to the claim.

 

8. Warranties and Disclaimers

We provide our IT field services with reasonable care and skill, but ITG Onsite Technicians does not warrant that the services will meet all of your expectations or be free from defects. We make no representations or warranties regarding the performance of third-party hardware or software, nor do we guarantee the continued functionality of any equipment after our services are completed.
Where applicable, any warranties provided by manufacturers or third-party service providers will be passed on to you.

 

9. Termination

You may terminate this agreement at any time by notifying ITG Onsite Technicians in writing. In such cases, any fees for services rendered up to the date of termination will be due and payable.

ITG Onsite Technicians may also terminate this agreement if:

  • You fail to pay fees as agreed.
  • You breach any terms of this agreement and fail to rectify the breach within a reasonable time frame.
  • You refuse to provide necessary access or support for the performance of services.

Termination will not affect any rights or obligations that have accrued up to the date of termination.

 

10. Indemnification

You agree to indemnify and hold harmless ITG Onsite Technicians, its employees, agents, and contractors from any claims, damages, losses, or liabilities (including attorney fees) arising from your breach of these Terms, negligence, or actions that cause harm to third parties.

 

11. Changes to Terms

ITG Onsite Technicians reserves the right to modify or update these Terms at any time, and any changes will be posted on this page. You are encouraged to review the Terms periodically for updates. Continued use of our services after such modifications will constitute your acceptance of the new Terms.

 

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland/Australia. Any disputes arising from these Terms or our services will be resolved in the appropriate courts located in Brisbane, Queensland.
